Terms of Service

1. Introduction

These Terms of Service ("Terms") govern your access to and use of Duta (the "App" or "Service"), an application that helps users manage, prepare, and publish affiliate videos featuring household products to TikTok. By accessing or using the App, you agree to be bound by these Terms.

2. Acceptance of Terms

By creating an account, connecting a TikTok account, or otherwise using the App, you confirm that you have read, understood, and agree to these Terms. If you do not agree to these Terms, do not use the App.

3. Description of Service

The App provides tools to manage video content, prepare affiliate video content, and publish that content to TikTok through TikTok's official APIs. The App does not sell products directly and is not an e-commerce platform. The App does not manufacture, warehouse, ship, or fulfill any household products referenced in videos published through it.

4. User Eligibility

You must be at least 18 years old, or the age of legal majority in your jurisdiction, and capable of forming a binding contract to use the App. You must also meet any age or eligibility requirements imposed by TikTok in order to connect a TikTok account.

5. User Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activity that occurs through your account.
• The accuracy and legality of any content you upload, prepare, or publish.
• Complying with all applicable laws relating to affiliate marketing and advertising disclosures.

6. Acceptable Use

You agree not to use the App to:

• Upload or publish content that is unlawful, fraudulent, deceptive, or infringing.
• Violate the intellectual property or other rights of any third party.
• Attempt to interfere with, disrupt, or gain unauthorized access to the App or its systems.
• Circumvent, disable, or otherwise interfere with TikTok's platform policies through the App.

7. User Content

You retain ownership of the videos, captions, links, and other content you upload or prepare through the App ("User Content"). By using the App to publish User Content to TikTok, you grant the App a limited license to process, store, and transmit that content solely for the purpose of providing the Service. You are solely responsible for ensuring you have the necessary rights to any User Content you upload or publish.

8. Third-Party Services

The App relies on third-party services, including TikTok, to provide certain features. The App is not responsible for the availability, content, or policies of third-party services. Your use of TikTok is subject to TikTok's own terms of service and policies, which are separate from these Terms.

9. TikTok Integration

The App may integrate with TikTok APIs to enable publishing and content management features. In connection with this integration:

• TikTok integration is optional. You are not required to connect a TikTok account to access the parts of the App that do not depend on it.
• You authorize the App before any TikTok account data or functionality is accessed, and access is granted only through TikTok's official authorization flow.
• You are responsible for the content you publish through the App, including its accuracy and legality.
• You must comply with TikTok's applicable policies and Community Guidelines when publishing content through the App.
• The App is not affiliated with, endorsed by, or sponsored by TikTok.
• TikTok may change, suspend, or discontinue its APIs at any time, which may affect the App's functionality.

10. Intellectual Property

The App, including its design, code, and branding (excluding User Content and any third-party trademarks), is the property of its developer and is protected by applicable intellectual property laws. You may not copy, modify, or distribute the App except as permitted by these Terms.

11. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how information is collected, used, and protected.

12. Disclaimer

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. The App does not guarantee any specific results from publishing content to TikTok, including views, engagement, or affiliate earnings.

13. Limitation of Liability

To the maximum extent permitted by applicable law, the developer of the App shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the App.

14. Service Availability

The App is provided on a best-effort basis. We do not guarantee uninterrupted or error-free operation and may modify, suspend, or discontinue any part of the App at any time, including features that depend on TikTok's APIs.

15. Changes to These Terms

We may update these Terms from time to time. Material changes will be reflected by updating the Effective Date above. Continued use of the App after changes take effect constitutes acceptance of the revised Terms.

16. Termination

We may suspend or terminate your access to the App at any time if you violate these Terms. You may stop using the App and disconnect your TikTok account at any time.
